Website Terms and Conditions of Use
Please read these Terms and Conditions of Use (“Terms”) carefully before accessing, or participating in any chatroom, newsgroup, bulletin board, mailing list, website, transaction or other on-line forum available at www.bellevue.edu or any affiliated websites owned by Bellevue University, a Nebraska non-profit corporation, which contain authorized links to these Terms (collectively, the “Sites” or “Bellevue University Sites”).
By accessing or using the Sites in any way, including using any Services (as defined below), downloading Materials (as defined below) or merely browsing the Sites, you signify that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Sites.
Changes to these Terms
Bellevue University may change these Terms and other guidelines and rules posted on the Sites at any time, with or without notice to you. Your continued access or use of the Sites, or any Materials or Services, constitutes your agreement to be bound by them.
If you breach these Terms, your authorization to access or use the Sites, Services and Materials automatically terminates, and any Materials downloaded or printed from the Sites in violation of these Terms must be immediately destroyed. These Terms are in addition to Bellevue University’s other terms, conditions, policies, rules and regulations relating to course instruction and other educational programs and opportunities provided by Bellevue University.
The Sites
The Sites, including all Materials and Services provided via the Sites, are available for your access and use subject to these Terms. “Materials” means all information, data, documents, communications, downloads, files, text, images, photographs, graphics, videos, webcasts, publications, content, tools, resources, code, programs and products made available or enabled via the Sites by Bellevue University. “Services” means all services and resources offered or enabled via the Sites by Bellevue University and users of the Sites, including download areas, information services and communications services such as online bulletin boards, social networking sites, blogs, Wikis, calendars, forums and other message or communication facilities designed to enable you to communicate with others.
Accounts
You are solely responsible for making all arrangements necessary for you to have access to the Sites. To access the Sites, including all Materials and Services, you may be asked to provide certain registration details or other information. It is a condition of your use of the Sites that all the information you provide on the Sites is correct, current, and complete. You agree that all information you provide to register with the Sites or otherwise is governed by the Bellevue University Website Privacy Policy, and you consent to all actions we take with respect to your information consistent with the Bellevue University Website Privacy Policy.
If you choose, or are provided with, a user name, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer, so that others are not able to view or record your password or other personal information. You are responsible for all content submitted and activity that occurs under your account, even if done by third parties who have accessed the Sites through your account.
We have the right to disable any user name, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion, for any or no reason, including if, in our opinion, you have violated any provision of these Terms.
Children Under the Age of 13
The Sites and Services are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Sites or Services. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Sites or Services or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at privacy@bellevue.edu.
Intellectual Property; Trademark Information
In consideration for your agreement to these Terms, Bellevue University grants you a personal, non-exclusive, non-transferable license to access and use the Sites and Services. You may download and use Materials from the Sites only for your own personal, non-commercial use. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense, reverse engineer or otherwise transfer any Sites, Materials or Services. The Sites, Materials and Services, as well as their selection and arrangement, are protected by copyrights, trademarks, patents, trade secrets and all other intellectual property and proprietary rights (collectively, “Intellectual Property Rights”). Except as expressly provided herein, Bellevue University does not grant you any express or implied rights to use the Materials and Services. You agree not to use any data mining, robots or similar data gathering and extraction methods in connection with the Sites, Services or Materials.
The logos, names, URLs, domain names and all graphics on the Sites of Bellevue University (“Marks”) are the trademarks of, and the property of, Bellevue University or its affiliates. You are not permitted to use, reproduce, copy or redistribute the Marks without the prior written consent of Bellevue University or its affiliates.
Use of Sites and Services
You may use the Sites, Materials and Services only as intended by Bellevue University and in accordance with all applicable laws. You shall pay all costs and charges, including phone charges and telecommunications equipment costs, that you incur in order to access or use the Sites, Services and Materials. You are solely responsible for the content of any transmissions you make to the Sites or to any Bellevue University faculty member, employee, contractor, agent or student. You agree that you shall not:
- Promote any unlawful activity or purpose, including without limitation, any activity that could give rise to criminal or civil liability.
- Collect, harvest, mine or engage in any other activity to obtain e-mail addresses, phone numbers, personal information or any other information about Bellevue University employees, faculty members, students, or others.
- Use or attempt to gain access to or use another’s account, password, Services, Materials or computer systems connected to any Bellevue University server or to the Sites, whether through hacking, password mining or any other means.
- Remove or falsely add to any Materials any copyright, trademark or other legal or proprietary rights notices, author attributions or other information such as origin or source of the Material(s).
- Make available any files containing Materials where you do not own or control, or have not received the necessary licenses to, all Intellectual Property Rights, rights of privacy and publicity and all other rights in and to such Materials.
- Use the Sites, Services or any Materials in any manner that infringes any Intellectual Property Rights or other rights of any party.
- Disrupt or interfere with the security of, or otherwise cause harm to, the Sites, or any Services, Materials, systems resources, accounts, passwords, servers or networks connected to or accessible through the Sites or any affiliated sites.
- Transmit unsolicited or bulk communications to any Bellevue University affiliated e-mail address.
- Post or otherwise submit any software, programs or files that are harmful or disruptive of another’s equipment, software or other property, including any corrupted files, time bombs, Trojan horses, viruses and worms.
- Create a false identity on the Sites for the purpose of misleading others.
- Download any Materials posted by another that you know, or reasonably should know, cannot be legally reproduced, distributed, performed or displayed in such manner.
- Disrupt, interfere or inhibit any other user from using and enjoying the Sites or other affiliated or Linked Sites, Materials or Services.
- Breach any guidelines, rules, policies or other codes of conduct applicable to your status with Bellevue University and your activity on the Sites, including, but not limited to, the policies provided in the Bellevue University Student Handbook, the Bellevue University Course Catalog, applicable Bellevue University Employee and/or Faculty Handbooks and related policy statements (“Bellevue University Policies”).
- Access or use the Sites in any manner that could damage, disable, overburden or impair any Bellevue University server or the network(s) connected to any Bellevue University server
- Violate any applicable laws or regulations related to the access to or use of the Sites, Services or any Materials or engage in any activity prohibited by these Terms.
- Post or otherwise submit any topic, name, material or information that contains child pornography, defamatory, excessively violent, harassing, inappropriate, indecent, lascivious, lewd, obscene, profane, racist, unlawful, or otherwise objectionable content.
- Prepare, compile, use, download or otherwise copy any Site user directory or other user or usage information or any portion thereof, or transmit, provide or otherwise distribute (whether or not for a fee) such directory or information to any third party.
- Engage in any chain letters, contests, junk e-mail, pyramid schemes, spamming, surveys or any other duplicative or unsolicited messages (commercial or otherwise).
- Violate the rights of Bellevue University or any third party (including rights of privacy and publicity) or abuse, defame, harass, stalk or threaten another.
- Use any Bellevue University domain name as a pseudonymous return e-mail address.
- Market any goods or services for any business purpose (including advertising and making offers to buy or sell goods or services), unless specifically allowed to do so by Bellevue University.
- Probe, scan or test for vulnerabilities of our Sites, Services, other websites, or any networks connected to them.
- Impersonate or attempt to impersonate any Bellevue University employee, another user, or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing).
- Forge headers or otherwise manipulate identifiers or Materials in order to disguise the origin of any content transmitted on the Sites.
- Engage in any activity that may interrupt, destroy, or limit the functionality of the Sites or of any computer software, hardware, or telecommunications equipment.
- Disrupt the normal flow of dialogue or act in a manner that negatively affects others users’ ability to engage in real-time exchanges and interactions with the Sites and other users.
- Circumvent, disable, or otherwise interfere with security-related features of the sites, including without limitation features that prevent or restrict the use of copying of any content or enforce limitations on the use of the Sites.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Use the Sites as part of any effort to compete with us or otherwise use the Sites for any revenue-generating endeavor or commercial enterprise.
- Otherwise attempt to interfere with the proper working of the Sites.
The foregoing list of prohibitions provides examples of prohibited conduct and is not a complete or exclusive list. In addition, if you are a student of Bellevue University or an employee or faculty member of Bellevue University, you have certain responsibilities with respect to your conduct as set forth in applicable Bellevue University Policies. Your conduct on the Sites is subject to and must fully conform with the Bellevue University Policies. Violation of the Bellevue University Policies (and any other policies, rules or guidelines that may be applicable) may result in appropriate sanctions, as determined in Bellevue University’s sole and absolute discretion, in addition to the any other consequence, penalty or liability that may result from such behavior.
Monitoring
Bellevue University has no obligation to monitor the User Content (defined below) on the Sites or Services and is not responsible for the content of any User Content transmitted by users on the Sites or Services. Bellevue University reserves the right to delete and take other appropriate action with respect to such User Content which Bellevue University, in its sole discretion, deems objectionable or otherwise in violation of these Terms, including denying access to the Sites to anyone at any time, but is not obligated to do so.
By posting or submitting messages, information or files (“User Content”), you represent and warrant that you own or otherwise control all of the Intellectual Property Rights and other rights to such User Content, including all the rights necessary for you to post or submit such User Content. You are solely and entirely responsible for all User Content that you post or otherwise submit via the Sites or Services. You shall assume all risks associated with the use of such User Content including any reliance on the accuracy, completeness or usefulness of such User Content. Bellevue University does not guarantee the accuracy, integrity or quality of the User Content. You acknowledge and agree that by accessing or using the Sites or Services, you may be exposed to User Content from others that are offensive, indecent or otherwise objectionable.
Bellevue University’s Rights to User Content
For all User Content that you post or otherwise submit to the Sites or Services, you grant ellevue University and the users of the Sites and Services an unrestricted, irrevocable, on-exclusive, worldwide, royalty-free and fully paid up license under all Intellectual roperty Rights to use, reproduce, publicly display, publicly perform, copy, edit, modify, ranslate, reformat, transmit and distribute such User Content, with or without having your ame attached to such User Content, in any manner or form and for any purpose, with ull rights to sublicense such rights through multiple tiers of distribution. You acknowledge nd agree that Bellevue University shall not be liable for any failure to store such User ontent on the Sites or Services at any time.
Restriction and Termination of Use
Bellevue University may block, restrict, disable, suspend or terminate your access to all or part of the Sites, Services and Materials at any time in Bellevue University’s sole discretion, without prior notice or liability to you.
Links to Third-Party Sites
The Sites, Services and Materials may include hyperlinks that will take you to websites maintained or controlled by others (“Linked Sites”). The Bellevue University name and logo may appear on Linked Sites, as a way to conveniently notify students of the sale of certain materials specified for Bellevue University’s curriculum. Linked Sites are provided by Bellevue University to you as a convenience and the inclusion of the links does not imply any endorsement by Bellevue University of any Linked Site. You acknowledge and agree that Bellevue University is not responsible for and does not routinely screen, approve, review or endorse the contents of or use of any of the products or services that may be offered at these Linked Sites. You further acknowledge and agree that Bellevue University is not responsible for any form of transmission (e.g. webcasting) received from any Linked Site. Your use of Linked Sites is subject to any applicable policies and terms and conditions of use, including but not limited to, the Linked Site’s privacy policy.
Reliance on Information Posted
The information presented on or through the Sites is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Sites, or by anyone who may be informed of any of its contents.
The Sites may include content provided by third parties, including materials provided by other users, bloggers, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by Bellevue University, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of Bellevue University. Warranties and Disclaimers
THE SITES, SERVICES AND MATERIALS ARE PROVIDED BY BELLEVUE UNIVERSITY UNDER THESE TERMS “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, PERFORMANCE, SECURITY, INTEGRATION, QUIET ENJOYMENT, SATISFACTORY QUALITY, AND THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

International Users
The Sites can be accessed from countries around the world and may contain references to Bellevue University services and programs that are not available in your country. These references do not imply that Bellevue University intends to announce such services or programs in your country. The Sites are controlled, operated and administered by Bellevue University from the United States of America. Bellevue University makes no representation that the Sites, the Services or Materials are appropriate or available for use at other locations outside the United States, and access to the Sites from territories where the Sites, the Services or Materials are illegal is prohibited. Personal Information and Privacy
Bellevue University will use and protect your personal information in accordance with the Bellevue University Website Privacy Policy, the contents of which are incorporated by reference into these Terms.
Indemnity and Liability
You will indemnify, defend, and hold harmless Bellevue University, its subsidiaries, affiliates, and each of their respective officers, directors, employees, agents, successors, and assigns (the “Indemnified Parties”) from and against any claim or demand (including reasonable attorneys’ and experts’ fees and costs), made by any third party due to or arising out of (i) your breach of these Terms; (ii) your improper use of the Sites, Materials, or Services, or (iii) your violation of any law or rights of a third party, including related to any User Content you provide or post. Bellevue University reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any matter without Bellevue University’s written consent. While some jurisdictions may limit your liability hereunder, this indemnity shall apply to the fullest extent permissible by applicable law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE INDEMNIFIED PARTIES BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES, WHETHER IN CONTRACT OR TORT OR UNDER ANY OTHER THEORY OF LIABILITY, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, ANTICIPATED PROFITS, BUSINESS OR SALES, ANY LOSS OF GOODWILL OR REPUTATION, OR THE COSTS OF SUBSTITUTE GOODS OR SERVICES, EVEN IF THE INDEMNIFIED PARTIES, OR AN AUTHORIZED REPRESENTATIVE THEREOF, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF, BASED ON, OR RESULTING FROM (A) BELLEVUE UNIVERSITY’S SITES, MATERIALS, OR SERVICES; (B) THESE TERMS; (C) ANY BREACH OF THESE TERMS BY YOU OR A THIRD PARTY; (D) YOUR, OR ANY THIRDPARTY’S USE OF (OR INABILITY TO USE) THE SITES, MATERIALS, SERVICES, OR LINKED SITES, OR THE SERVICES ANY THIRD PARTY PROVIDES, RELATED TO THE SITES OR LINKED SITES; (E) ANY USER INFORMATION OR USER CONTENT; (F) ANY INTERACTION BETWEEN THE SITES OR SERVICES AND ANY THIRD PARTY OR LINKED SITE; AND (G) ANY ACTUAL OR ATTEMPTED COMMUNICATION OR TRANSACTION, INCLUDING WITHOUT LIMITATION, ANY TRANSACTION BETWEEN YOU AND LINKED SITES.
Class Action Waiver
By agreeing to these Terms, you agree that you are required to resolve any claim that you may have against Bellevue University or any of its affiliates on an individual basis, and not as a class, collective, coordinated, consolidated, mass and/or representative action. This Class Action Waiver will preclude you from bringing any class, collective, coordinated, consolidated, mass, and/or representative action against Bellevue University or any of its affiliates, and also preclude you from participating in or recovering relief in any current or future class, collective, coordinated, consolidated, mass and/or representative action brought against Bellevue University or any of its affiliates by someone else. Any and all disputes, claims, or controversies between the parties shall be resolved only in individual proceedings. The parties expressly waive the right to have any dispute, claim, or controversy brought, heard, administered, resolved, or arbitrated as a class, collective, coordinated, consolidated, and/or representative action, and neither an court, judge, arbitrator nor an arbitration provider shall have any authority to hear, litigate, arbitrate, or administer any class, collective, coordinated, consolidated, and/or representative action, or to award relief to anyone but the individual in individual proceedings. The parties also expressly waive the right to seek, recover, or obtain any non-individual relief.
A court, tribunal or arbitrator may not preside over any action joining, coordinating, or consolidating the claims of multiple individuals against Bellevue University in a single proceeding. If there is a final judicial determination that any portion of this Class Action Waiver is unenforceable or unlawful for any reason, (i) any class, collective, coordinated, consolidated, and/or representative claims subject to the unenforceable or unlawful portion(s) shall proceed in a court of competent jurisdiction; (ii) the portion of the Class Action Waiver that is enforceable shall be enforced in a court of competent jurisdiction; (iii) the unenforceable or unlawful portion(s) shall be severed from this Class Action Waiver; and (iv) severance of the unenforceable or unlawful portion(s) shall have no impact whatsoever on the enforceability, applicability, or validity of the Class Action Waiver.
Spam Email and Postings
In the event of your or others’ access to or use of the Sites, Services or Materials in connection with the transmission of spam newsgroup postings or unsolicited e-mails in violation of these Terms, you acknowledge and agree that Bellevue University would be irreparably harmed thereunder and that monetary damages would be an insufficient and ineffective remedy; therefore you agree that Bellevue University is entitled to obtain immediate injunctive relief against any such transmission (in addition to all other remedies available at law or in equity). Bellevue University may without restriction block, filter or delete unsolicited e-mail.
SMS Terms and Conditions
Bellevue University’s text messaging service gives you the option to subscribe to receive text messages on your mobile device. SMS messaging will be used to provide information on upcoming events and announcements, as well as important admission and student servicing reminders. Standard message and data rates may apply. Frequency of messages may vary. Subscribing to this service is not required to apply for or gain admission to Bellevue University, and is used only for matters that Bellevue University deems helpful and pertinent. All mobile information you share will be subject to the Bellevue University Website Privacy Policy and will only be used by Bellevue University representatives to assist you in a more efficient manner regarding the admission process and student servicing. For additional information please refer to Consumer Information at https://www.bellevue.edu/consumer-information/. All messaging and data rates from wireless carriers are your responsibility.

Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflicts of laws provisions. You irrevocably agree to the exclusive jurisdiction of the courts of the State of Nebraska for any disputes arising out of these Terms. The parties to these Terms and any of their affiliates, assignees, or successors waive the right to a trial by jury on any claim relating to or arising out of these Terms or use of the Sites.
General
The introductory paragraph, and any documents that are linked to or referenced in these Terms, are hereby incorporated by reference and made part of these Terms. Collectively, the foregoing constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms. Notwithstanding the foregoing, you expressly acknowledge that your obligations and responsibilities under the Bellevue University Policies, as applicable, are not superseded by these Terms and that the Bellevue University Policies shall be used together with these Terms to further the purpose of these Terms to the fullest extent allowed by law. If for any reason a court of competent jurisdiction finds any provision of these Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected by that provision, and the remainder of these Terms shall continue in full force and effect. Any failure by Bellevue University to enforce or exercise any provision of these Terms or related right shall not constitute a waiver of that right or provision. The section titles used in these Terms are purely for convenience and carry with them no legal or contractual effect. These Terms shall be binding upon and inure to the benefit of both parties and their respective successors and permitted assigns. These Terms may not be assigned by you without Bellevue University’s prior written consent. Bellevue University may freely assign these Terms to any third party.
Copyright Infringement Complaints
Bellevue University respect the intellectual property rights of others and it prohibit users from posting on the Sites and Services any content that violates another party’s intellectual property rights. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides a complaint procedure for copyright owners who believe that the Sites or Services material infringes their rights under U.S. copyright law. If you believe that your work has been improperly copied and posted on the Sites or Services, please provide Bellevue University with the following information: (1) name, address, telephone number, email address and an electronic or physical signature of the copyright owner or of the person authorized to act on his/ her behalf; (2) a description of the copyrighted work that you claim has been infringed; (3) a description of where on the Sites or Services the material that you claim is infringing is located; (4) a written statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (5) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. These requirements must be followed to give Bellevue University legally sufficient notice of infringement. Send copyright infringement complaints to:

We suggest that you consult your legal advisor before filing a DMCA notice with Bellevue University’s copyright agent. There can be penalties for false claims under the DMCA.
