Universities continue to explore the most effective and ethical protocol to address students who pose a direct threat to the campus community and themselves. However, a recently revised "direct threat" regulation under Title II of the ADA is causing some confusion for higher education professionals. As of March of 2011, a new provision in federal disability law under Title II narrowed the definition of "direct threat" to include only threat to others.

This means that it is now discriminatory to dismiss or discipline a student on the basis of their suicidal or self-harming behaviors. While higher education administrators continue to grapple with myriad of complex ethical, clinical and legal issues inherent in the management of suicidal students, this regulation change provides a lens through which the issues must be reevaluated.
